Why I Specialize in Inherited Property

Simply put, in listed properties, this is the place where I can help the most. These properties and their owners are benefited by working with an agent who is experienced in both probate and working with Successor Trustees. Why? Probate has its own peculiarities that require skill in working with attorneys, seller members who may need tender attention or conflict management, and an agent who knows the limitations of probate property sales. Successor Trustees also need comforting care but also an agent who can navigate the legal aspects of the sale, whether or not the original Trustee is still living or is deceased. Neither type of sale is like a regular listing. I believe in solving problems before they even exist. With planning and experience, we can make the transition of either type of property as seamless as possible.

Navigating the Alien Landscape of Inheriting a Property

Quite often, this is a difficult time for sellers. They have inherited a property or their family has passed away without a Trust. Whether you are a Successor Trustee of a Trust or dealing with Probate court and your attorney, the process of selling the property is handled with compassion and patience.

Successor Trustees

Whether your loved one has passed or you are in a conservator capacity, if you list the property with me, our first order of business is to make sure the title to the property is in proper condition. I will shepherd you through the process with a local trusted title company who will review your Trust documents, ascertain your rights to convey, request the death certificate if appropriate or the needed documents from the legal owners medical provider. From there, the property listing is treated like any other. Professional photos, floor plan, aerial photography, all the things you expect from a premium agent. Just because it’s an inherited property doesn’t mean the marketing plan is less.

Properties in Probate

I am a certified Property Specialist by the California Association of Realtors. These types of properties are especially stressful for the seller. When home owners pass away without a Trust, the property must go through the court probate process. This is a court process and you will need an attorney if you don’t already have one. The court, through it’s processes, determines how the sale of the property will be handled and how the distribution of the resulting assets will be allotted. I’d be pleased to give you some attorney suggestions if needed. At any time, you can reach out to me so we can start the process of working together. After you retain an attorney, I will be working very closely with them.  There are two types of probate sales, court approval needed and no court approval needed. As you may already know, the court sets the listing price of your property. Here is what sets me apart though …. I treat probate listings exactly the same way as any other listing. Professional photos, floor plan, aerial photography, all the things you expect from a premium agent. Just because it’s a court controlled sale property, doesn’t mean the marketing plan is less. The marketing plan can often help drive the price above what the court is expecting which equals more money for the family. In some if not most cases, the sellers are excluded from property disclosures other than those mandated by the state. The caveat that are sellers who have significant knowledge of the property or have lived there personally.

Throughout the process, I’m with you every step of the way, making sure your questions are answered and that the entire experience is a positive one.
